Lawless In Iraq

Would somebody please explain to me how this sort of random killing is NOT first degree murder:

A group of foreign contractors traveling in three SUVs shot at a passing car in the northern city of Kirkuk, killing two Iraqis, a police officer from Kirkuk said.

'The foreign contractors were in three SUVs driving from Arbil to Kirkuk and they shot at a passing car in which two Iraqis were seated. The two died,' Khairalla Abdullah said.
